Flooding of Yuyao, How the Chinese Government Created Enemies In a Natural Disaster

Yuyao is a county-level city in Ningbo Prefecture, Zhejiang Province. Due to Typhoon Fitwo, much (over 70% of downtown) of Yuyao had been underwater.

Natural disaster like this is often seen as God-sent for western politicians, as this set a great stage with free and unlimited camera time for them to demonstrate how much they care about their constituents in need. Mayor Giuliani, Governor Christie and President Obama all had their political lives saved or elevated from major disasters. However, in Chinese politics, where it is mysteriously held that even a natural disaster could be the fault of top officials, the No. 1 priority of any level of government officials was to bury any negative news as much as they could.

So it was not surprising that there had been little media coverage for this flood, even though Yuyao was one of most prosperous cities in one of most prosperous provinces, and that it was within an hour's drive from most major cities in eastern China, including Ningbo, Hangzhou and Shanghai.

Three days after the beginning of the flood, and while over 50% of its downtown still submerged in water, the local government broke the silence and denounced that water had receded, and that nobody had died despite floating bodies nearby.

Angry residents asked the official reporters of Ningbo TV to turn their camera away from the only dry place in town, and tell the outside world the need for disaster relief assistances. The journalists were offended, and cursed the residents of being mentally sick in failing to recognize that they were on official propaganda mission. A brawl ensued.

For the first time since the flood began, many local resident saw police SWAT team on the street. Not to help with the flood, but to beat people with batons. More people rushed to argue with the police, and even larger group of people joined the battle.

A recent crackdown of online rumor spreading might have caused the initial delay in rescue and relief efforts. The government recently announced through a joint memorandum of judicial interpretation by the Supreme Court and the Supreme Procuratorate that any misinformation would be prosecuted with criminal code. The legal recognition of 'misinformation' had been exemplified by a series of cases in the past few weeks. For example, when 5 cars were involved in an accident, if someone posted online that 4 cars were involved, then it would have broken the law. A Henan women was arrested because she posted these language (a literal translation: "I heard there was a crime took place in the neighboring village last night, was it true?") A middle school student in Gansu Province was arrested when he questioned why didn't local police act to track down the criminal of a homicide case. In a sharp contrast to the busy online mobilization and coordination of rescue and relief after previous disasters, such as the Sichuan earthquake and the bulletin train accident, almost nobody talked about the unprecedented flooding in Chinese online media for days.

A hundred and four years ago on October 4, 1909, a famous minister Zhang Zhidong passed away. Zhang was deemed that last capable minister in the Qing Dynasty (1644-1911). In his last days Zhang had a conversation with the Prince Regent Zaifeng. Knowing it would be his last opportunity to pass his concerns to the rulers, Zhang tried to point the Prince people's resentment to the Court. Zhang cautioned Zaifeng that he should listen to what people were complaining. The Prince stopped him, and assured him that nothing should be worried about because 'we had soldiers'. Later Zhang recounted the exchange in utter disgust, and labeled the 'we have soldiers' phrase as a sign predicting collapse of government. Zhang died in three months, and one year later, Qing collapsed in a sudden when a few soldiers in Wuchang rebelled.

The Leading Princelings

Vice President Xi Jinping is due to assume the supreme-leadership of China in one year. Many cited words such as confidence as their first impression, but it could be simply arrogance in disguise.

Other leading Princelings do not fare much better either.

Bo Xilai, the Governor of Chongqing Metropolitian, had been finding his way to the top by revitalizing the Great Cultural Revolution under his absolute reign of the Southeastern city. Thousands of people were persecuted and jailed without going through legal system, some executed despite national outcry. On February 6th, his henchman the police chief Mr. Wang Lijun walked in the US General Consulate in Chengdu seeking asylum protection from Bo himself. The move effectively marked the end of his political ambition.

General Liu Yuan, son of former President Liu Shaoqi who was persecuted to death in the Great Cultural Revolution, had an unusual hurdled path in his political ascending. It seemed the overwhelming national sympathy on his father's tragic political farewell was not enough to propel him at any level in the past 30 years. Liu had to be moved across the board each time to get a promotion. He had been the Governor of a Province, Commander of Paramilitary Troops, Party Boss of a university before being named a Lieutenant General in the Logistical Corp.

Liu made quite a few splashes in what used to be a quiet-on-the-surface pool of political affairs in Beijing one year before the once decade power transition. A deputy of his, Lieutenant General Gu Junsheng was removed from duty under fraud investigations, echoing his vows made last month to fight corruptions in the army. Liu also backed his advisers to make voice on state issues. For example, he ordered the Army to publish a book authored by his adviser Zhang Musheng.

As a matter of fact, both the outsider world, as well as people in China with opposing political views are having great expectations on the new leadership, partially because of the current core's seemingly weakness when facing interest groups.

Xi himself does not have a clean record:

  • Xi divorced his wife, then married a young pop star Ms. Peng Liyuan;
  • Xi was the Governor of Fujian Province when the 'largest smuggling scandal' broke out;
  • Xi was the Governor of Zhejiang when the corruption of Leqing County took place, which ultimately led to public execution of a Village Head Qian Yunhui;
  • Xi ordered to use a girl with better appearance to act in voice of another non-presentablegirl at the opening ceremony of the 2008 Beijing Olympic;
  • Xi obtained a J.D. from Qinghua University without attending a single lecture in classroom nor writing a single line on paper;
  • Xi interfered to sentence business woman Wu Ying to death so that some local officials in Zhejiang could take her fortune.

After a long waiting, The Princelings are ready to set off conquering the world, but are you ready for the manner it would be executed?

尊敬的法官任国权,以及另外两位未谋面的将在判决书上署名的法官:

我之所以用尊敬两字,是因为法官两个字,本身是很尊贵的。即便是我们法律人说来,法律也是很神圣的,更何况一般的百姓。毕竟一个国家大多数情况下,依赖法律来维系。谁破坏了法律,实际上是自毁长城,离祸乱不远,历史上的例子比比皆是。而具体法官自身是否值得尊敬,端赖法官个体的行为,或被人鄙夷,或受人尊敬。每个人都有自由意志,路都自己选择,没什么可以做挡箭牌。

大家也不必兜圈子,贵院也没有把这个案子(费良玉交通肇事案)当作普通的交通肇事案处理,正如一审时的,如临大敌,未按法律规定的方式完全公开开庭,仓促开庭,草草下判。一审我未提交书面的意见,因为该说的,都已经在庭上说了,虽然法庭记录中忽略了我的几次抗议。这些抗议,主要是针对法庭开快车,踩油门,就如机器一样,就想在既定时间完成既定事项。这样做,既不尊重法律,也不尊重当事人。对费良玉不公平,对我的当事人死者钱云会的家属,更不公平。

犹如现在很多体制内的官员说,费良玉案是否是交通事故,信者恒信,不信者恒不信。这话,说得很对。然而,可以说,信者大部分是体制内的,不信者大多是普通网民,人数多寡,你们也清楚。如果法院本身做到公开、公正,即使天下人都不信,我作为受害人的律师,也会大声说法院没做错,他们行使的是法律赋予给他们的权力,他们公正的行使了这个权柄,法庭外的人不信,是他们的错。这三个法官对得起,我们称呼他们尊敬的法官。

然而,一审开庭硬伤太多,正如我向任法官面谈时提出几点大概,

一,书证中,当天缺少费良玉打电话的记录,公安110记录中报案时间是9点30分。我们有理由怀疑当天案发时间不是9点45分,而是传闻中的9点30分04秒。因为根据费良玉的笔录,(2010年12月28日第4页)“我下车看到那个行人被压在车轮下不动了,我马上用自己的手机打110报警”。一审认定这个时间9:45,和一审检方提供的录像时间是不相符的。即使,录像时间也和一审认定时间不符。

二,物证中,录像没有经过是否修改、剪辑的鉴定。因为该录像经过多人之手,且录像和书证、人证有不符合之处。民间纵有无数技术人员说该录像有修改、剪辑之处,然而,法律只能相信有权机关的鉴定,如果少了有权机关的鉴定,一审判决中把这种存疑的录像做证据,显然违反刑事诉讼法规定的证据确凿的原则。代理人自己寻找的数家有资质的鉴定机构,他们都表示需要公检法出具委托手续,否则无法接受鉴定。因此,二审有必要对此进行鉴定。

三,证人中,检方对关键的证人证言,只让对交通事故有利的黄标出庭作证,未让王力权,钱成宇出庭作证。在选择证人上有明显的偏向,这些证人都掌握在检方手里,根据最高人民法院关于执行刑事诉讼法的解释,第141条的规定,证人应当出庭,一审法院不让其他证人出庭,并无合法理由。虽然,实践上, 证人不出庭的违法现象已经司空见惯,然而,既然,贵院让黄标出庭,似乎已经打破了这个惯例,那么,黄标对费良玉、检方有利,是否应该对钱云会家属公平一点,让钱成宇、王立权等也出庭呢?检方手里都是好牌,发给受害人家属的都是差牌,有这样玩弄法律的吗?

现在贵院决定二审不公开开庭了,代理人只能对此表示愤怒。按照目前的法律,二审确实可以书面审理,但是,是有条件的。最高院关于刑事诉讼法的若干问题解释第253规定,对上诉案件,应当组成合议庭,开庭审理。经过阅卷,询问被告人、听取其他当事人、辩护人、诉讼代理人的意见后,合议庭认定的事实与第一审认定的没有变化,证据充分的,可以不开庭。因此,司法解释明确规定,开庭是惯例,不开庭是例外。这里,你们又打破了惯例。

任法官和贵院的发言人只是听了代理人十几分钟时间,也未做任何笔录,就算听取了代理人意见?难道就能认定事实和第一审认定的没有变化?一审录像没有做鉴定,二审也准备葫芦僧判葫芦案?一审疑点没解释,二审准备外甥打灯笼?

回到案件本身,正如代理人向任法官反映的,录像出得非常蹊跷,钱云会出事也非常蹊跷,据传,乐清政法委在钱云会出事前一天,已经开会决定,寨桥村选举期间不能让钱云会在村里。这或许是为什么出事当天有那么多保安在现场,这也可以解释为什么钱云会不敢住在自己家里!事实上,从录像看,当天并未施工!要这么多保安干什么?是否存在抓捕过程中的交通事故?一审笔录中,黄标的第一次、费良玉的第一次,都说道钱云会举手拦车,细节很清楚,钱为什么要拦车?后来说是两人预谋为减轻罪责,从来没有听说拦车减轻罪责的说法。面对如此巨大的钢铁怪物,钱云会一个人拦车?这种解释牵强附会,难以置信。

代理人并不预设立场,只愿程序公正,对结果,不苛求。毕竟人不是神,我们只能凭证据说话。一审中的证据无法排除诸多疑点,一审判决书虽长达28页,可有一字解释过代理人在庭上的质疑?法院可以掩耳盗铃,装聋作哑,可是,法律不该如此!受过多年法律训练的法律人,也不该如此。纵然有很大的压力,然而,做人总得有点基本的骨气!何况,你们是顶着国徽的法官。

警察对证人黄雪芬的审问是在凌晨,有这样询问证人的吗?这样的证言还被采信。换成你法官是证人,你认为深更半夜把你抓走去作证,正常吗?这样的证言可以采信吗?

钱云会手机中的电话记录为什么不调查出来?如果要排除其他疑点,这个是最有价值的线索,为什么不进行调查?

看过录像的四个人王立权、黄雪芬和王旭乐、王旭旭对录像内容描述大相径庭,一审都作为证人,采信的是王旭乐和王旭旭的证言,为什么?只要是对交通事故有利,就采信,只要是不利,就回避?一审判决可曾置一词解释为什么同样看过录像内容的人描述会完全不一样?

人会说谎,机器不会说谎,这就可以解释,为什么寨桥村的摄像头会失灵?也或许也可以解释,为什么录像不敢拿出去做鉴定?或许也可以解释,为什么费良玉的报警电话在记录中找不到?或许也可以解释,为什么费良玉不肯解释赔偿的巨款哪里来?或许都可以解释钱云会之死案为什么疑点重重?都是因为人可能会说谎,不管这个人是证人、犯罪嫌疑人、警察、检察官、律师。

这就是为什么法律要设置具体繁复的程序,让所有的会说谎的人和不会说谎的机器,呈堂证供,互相攻错,不同利益方也互相辩驳,展示每一个破绽、漏洞,最终,中立的旁观者作决定,有罪的定罪,疑罪的从无,无罪的,还其清白。这样的制度设置,才能保障犯罪嫌疑人的权利,同时也给受害人一个公平。也让旁听的人觉得,有人罪有应得,有人受冤蒙屈。

现在,贵院继一审的变相不公开开庭之后,变本加厉,认为书面审理就可以了。除了相信你们是神,我还能有什么解释呢?代理人猜测,或许等你们走下神坛时,相信案子会有反复,历史总归会有些反复的。不用说,诛奸谀于既死,发潜德之幽光的古代史了,就算建国以来,多少冤案被平反?而且,都是在共产党领导下的平反。代理人相信国人的自我平衡能力。

如前面所说,贵院既然不把这个案子当作一个普通的刑事案件来审,也请原谅代理人不用传统的方法来写代理词。根据我对司法的了解,也知道,你们或许也会受牵制,我们即使写数万字或许顶不了有的人一个字。我多写,只能是不智。你不让我开庭讲,我也不想白白写。

因此,最后,我对任法官和其他两位说一句话,这个案子不开庭,不鉴定,不解释,在法律之下,你们自己如果觉得心安了,你们可以把这个代理词撕了。因为,它已经不会起任何作用了。我记得有一本古书上写了“伸冤在我,我必报应”。如果法律都失灵了,民间能信的或许只有这个了!

Career Party Official Named Party Chief of Zhejiang University


On March 1, 2011, Mr. Jin Deshui was named the Party Chief of Zhejiang University. Zhejiang University the best university in Zhejiang Province and is viewed as a Top Ten in the nation.

The appointment is the first in decades to have an otherwise uneducated career party official placed on the No. 1 post of a major university. Usually the Party Chief of major universities are also scientists, though some no longer active in research.

It is not known whether this is a signal of a broader transition in higher education policy in China. Started from 1966, the Party abruptly suspended all higher education, and sent professors to farms to be re-educated with heavy labor. Mr. Jin Deshui never went to college, and his highest education record was a certificate from the Zhejiang Province CCP Party Committee Training School.

Child Eat, Mom Watch

Premier Wen Jiabao went online to chat with Netizens for the third time in three years. Regarding the rising grocery price, Wen told a story on a tour in Zhejiang Province last year. At a luncheonette attached to a supermarket, Wen saw a mom and a child who bought only one meal. The child was eating, and the mom was watching the child eating on the saide. Wen asked the woman how many children did she have. The woman started crying. She said this was the only child she had. She said her husband just passed away because of cancer. She only hoped she could keep the child with her in the city she was working as a migrate worker. Local officials accompanying Wen granted the child permission to attend school.

China still has hope, as long as someone higher up who is still of seeing and feeling the suffering of people.

Calling a Stag a Horse


The history has the strong this way: a powerful minister of Qing Dynasty (221-207 B.C.) Zhao Gao was planning a coup, so he wanted to tell how many ministers in the court would stand with him. Zhao had an idea. He presented a stag to the child emperor, 'Your Majesty! See the beautiful horse I brought you!' Still a child, the emperor was amused, 'but it's a stag', replied in joy. And the child emperor asked his ministers standing in the court, 'can't you all see?'

Most ministers kept silence. Some stated it must be a horse to please the powerful minister Zhao Gao. A few rebutted in distaste, and they were soon thrown into jail by Minister Zhao Gao.

Reading the history book, people can't help wondering, why it had to be carried out in this spectacular way?

People had been playing these seemingly meaningless mental game for thousands of years. In book 1984, Big Brother could not be satisfied until people sincerely agreed with 'guilt' placed on them. Big Brother is as obsessed on playing with people's mind as, who else, communists.

Qian Yunhui, a village head who stood up for his villagers, was executed by local government in Zhejiang Province to deter the villagers from asking for their fair share of their land taken away by the government when Dr. Xi Jinping was the Governor of Zhejiang. The execution was carried out in bright day light on a busy road, with local people walking around and residential buildings lined up on both sides. When it became a national and international media event, the CCP decided the original plot was not good for publicity. At that point, the government at all levels were mobilized for one task, 'Calling a Stag a Horse'. They did it, but they wanted everyone in the world to do it too, a mission impossible with today's connected world thanks to cell phone videos and micro-blogs. But boy they just don't quit.

After everything failed, after all government witness was proved lying and after all evidence presented by the government fabricated, the government 'found' new evidence, from villagers.

The official Xinhua News Agency reported, one villager who kept a 'spy watch' wore by Qian at the time of incident turned it to the authority 'voluntarily'. [Reality check: the villager, a close friend of Qian, was jailed all the time after the incident, and the watch was hidden at his home. Therefore, there is no way he can turn in the watch 'voluntarily'.] This is not an ordinary watch, but one with a video camera and a microphone, and is capable of recording 3 hours of video footage once triggered by a button, just like James Bond used in the movie. By the way, it's pretty cheap at below $20, and had been widely available everywhere in China. Many Chinese keep one, just in case, as admitted by writer and car racer Han Han. So watch out when you are sitting close to a Chinese. Anyway, for obvious reason, Qian activated the recording before the accident (why? My toddler would ask, and it's a good question as you don't do that all the time), and the watch recorded the whole incident in its entirely, and more. If you have been following the case, you would recall that the particular government surveillance video camera overseeing the crime scene was conveniently malfunctioned a few hours before the incident, and mysteriously recovered minutes after the incident took place. After the incident became a media frenzy, the government had plowed the village of a thousand resident to search and confiscated cameras and cell phones alike. Now, a month later, with the new critical evidence, and while all other methods had failed, the government had a new idea. Instead of destroying all physical recording, why not,..' Yes, you got it.

Twenty days later after the government obtained the watch, the official Xinhua News Agency published a 'unedited full-length' video recording of the magic watch, from the moment Qian walking on the road by himself, to the moment he was struck by a truck 'accidentally'. You can see the owner of the watch walking, the scene of the street, the truck coming, and the 'accident'. The Xinhua News Agency claimed it was clearly a traffic tragedy, see!

Within a day, bloggers were able to decipher the video and found bugs every where. It's not just 'edited', but rather 'assembled'. And it's not done by James Cameron of Hollywood, but Sandy Tartar of Bollywood. Many blogs explained in details how bad a job the government and Xinhua News Agency had done. here, here, here, here, here, here, here, and here.

As it is approaching the lunar calendar of the traditional Chinese New Year, consider sending a post card to the old father of late Qian Yunhui, who was brutally executed by the police one month ago in Yueqing, Zhejiang Province. Qian was the elected head of village Zhaiqiao. Because Qian led protest against taking villagers land without proper compensation, the local government chopped his head off with a heavy duty engineering truck at the entrance of the village in bright daylight, with villagers and travelers on the watch. Four police beat Qian, then hold his head down on the path a slow rolling wheel of the truck. When the accident caught national media attention, the government insisted it was an accident.

Qian's old father told reporters, at the moment Qian took the job six years ago, he knew Qian would be killed.

More Evidence Surface for the Yueqing Slain Village Chief

While governments of Yueqing County and Wenzhou City (upper authority) stand by the 'traffic accident' decision, more evidence surfaced to point the case to a murder/execution by government officials.

1) The surveillance camera. There is a surveillance camera which belongs to the China Telecommunication Company, a state wireless communication carrier, oversees the scene of the accident. The police initially stated the camera was not capable of video recording, but only browsing in real-time. However, people found a video clip published by the police of the scene was taken from that particular camera. Then the police said that camera was calibrated less than 24 hours ago, and was set to be in browsing-only mode until 10:00 am on Dec 25, 2010, which was minutes after the accident.

2) Police still refused to release pictures and videos showing the truck traveling from the engineering site to the accident scene to counter witnesses' claim that the truck had been idling at the scene before Mr. Qian was inserted under the wheel by four uniformed policemen. Police had since arrested anyone who claimed to have seen the accident, along with their family members, sons, daughters, son-laws, etc. Journalists were denied access to these people and their families.

3) Qian told his family that the government was going to hurt him. As a matter of fact, he had been in hiding for the 2 nights prior to 12/25/2010. In both nights of 12/23 and 12/24, he left home to hide in undisclosed friends' places and returned to home after daybreak. In the morning of 12/25/2010, he took a phone call, then told his family he had to go out immediately. His family believed the call was from a deputy town mayor, who was seen by many witnesses to have instructed the public execution at the scene. Police said the call was from his friend, Mr. Wang, instead of the deputy mayor. Police had arrested Mr. Wang along with his family members, and denied journalists access.

Almost as if a calculated move, another villager was crushed to death by an engineering vehicle in Henan yesterday. This time the heavy duty machine went ahead to crush a 40 years woman who stood on its path, in the watching of more than 100 government officials, police, and almost as many villagers. The news anchor of the Henan provincial TV Station did not try to cover his anger when he blamed the officials as standing by and cheering after the woman was crushed. The video also showed a local official as quoting him, 'it's not enough to crush only a couple of villagers. The people will be educated after a dozen'. This video, aired in a miracle in China, and had been spreading like wild fire on the Internet was promptly silenced. However, copies still living on foreign video hosts such as youtube.

Road Accident: Premeditated Murder or Public Execution?

With a new video, the dusts have settled down and what left for debate is: whether the 'traffic accident', as described by the police, is a premeditated murder as suspected by the victim's fellow villagers, or a public execution as demonstrated by the evidence?

Mr. Qian Yunhui is the head of a small village of 2,500 people in Yueqing, Zhejiang Province. About 20 acres land of the village was taken to build a power plant. Villagers learned that the land compensation grant was intercepted by local government. Qian vowed to get villager's money back by legal process and petitions to higher government. In the past 6 years, Qing was thrown to jail three times, and served a two years sentence for speaking for his villagers.

Tuesday morning, Qian received a call from the deputy mayor of town government, and left home in a hurry. Moments later, he was found dead under the wheel of an engineering truck. The official edition of the story is: Qian crossed the highway without watching carefully. The truck driver saw him too late, and compounded by the weather condition, failed to stop the truck.

A role in the CIS said, every body has a story to tell. Qian's body laid in an odd posture. The only wound on Qian was his neck, which was severed with the detached head still looks as if connected to the torso by the wheel. His body looks like knee-ed down to insert the head beneath the wheel.

According to witnesses, there were more than 10 security guards on the scene when 'the accident' happened. Four uniformed men inserted Qian under the waiting truck. The deputy mayor observed the process from a white government sedan. The uniformed men and the sedan left the scene shortly after. Within minutes, hundreds of riot police descended to the scene and started beating all witnesses.

The incident got media attention because Qian posted a detailed description of the dispute between the villagers and local government on Tianya, the most popular Internet site, six months ago. The post attracted little attention until some made the connection between the post and Qian's death. Despite mounting suspicious evidence and questioning from the media and Netizens, the Yueqing (county-level) government insisted the finding of 'traffic accident', and the higher up Wenzhou government confirmed the conclusion.

While the incident continued fomenting online, police detained all witnesses and had them retracted their testimonies. Police also confiscated any video recording equipment held by villagers. All villagers found at home were 'invited' to the police station for collaboration in the investigation. They would not be sent back home until signing a statement acknowledging the government's official story. The old generation vowed to resist, while most younger generations fled to friends and relatives.

A high qualify cell phone video was uploaded to the Internet on Thursday. Although the original clip was promptly removed, numerous copies survived on foreign video hosting sites such as youtube and videobeam. The video was taken only minutes after the accidents happened, before the arrival of riot police force. The video clearly showed the truck was in an unreasonable location relative to the road: off-road on the left side. It also showed the land beneath the truck was dry while it was raining. There was no 20 feet braking line as the police claimed, but a 5 feet print of path with clear tire patterns. It proved the truck was waiting at the scene to strike Qian. Also, the photo produced by the police in the government news press was proved to be faked because the official photo showed braking lines and scratches on the front bumper. None was present in the video.

As of the time of writing, police detained Qian's brother, sister in law, son, daughter in law, as well as all witnesses who had talked to media.

The new video did not contain the moment of the incident. However, it proved police faked evidence to make up the official story, and it is compatible to description portraited by witnesses.

The scene is covered by a surveillance video camera. The latest examination of that particular camera was only two days ago when it showed working normally. The government initially claimed the video camera was nonfunctional at the time, then claimed the camera was not capable of recording. A telecommunication engineer, also a Netizen, revealed that model of video system by default stream all video to a centralized file server to be stored for later discovery. Furthermore, the police presented a footage of the scene recorded from that camera about 2 hours after the accident took place in the news press. Also, according to the government's edition, the truck was on route from an adjacent village to a working site. Netizens challenged the government to release footage from the traffic cameras, altogether 24 in the described path, to show the truck had been moving instead of waiting at the scene in the 30 minutes prior to the accident. The government refused the request, citing security reasons.

It is perceived the police and the government was not interested in seriously covering up the incident. Instead, the regime is setting up an example for anyone dare to challenge the communists authority.

Xi Jinping, the next 'core' to succeed Hu Jintao in 2012, was the governor of Zhejiang Province. It is suspected that Xi had a role in the accident.

Around 60,000 Chinese died in car accidents in a year. It's not a big number considering the base population and the road conditions. Therefore, a person died from a car accident is not news worthy. What is news worthy though, is the current trend of killing a person through means of repeated crushing, often recorded by video cameras.

In this 2006 incident (video: http://www.56.com/u48/v_MTc4MjgyOQ.html) in Hangzhou, Zhejiang Province, an old lady was run over 5 times. January 20, 2009, A car ran over a 2 years old girl three times (video: http://video.sina.com.cn/p/news/s/v/2009-01-21/094360241336.html) in Ji'nan, Shangdong Province. September 13, 2010, a 3 years old boy was run over 4 times by a BMW driven by a CCP official. September 19, 2010, a man was run over three times (video: http://www.56.com/u97/v_NTQ5ODg0NzA.html) by an Audi.

None involved was ever charged murder, including the case when the lady was killed after being run over 5 times. In the recent case when the 3 years old boy was killed after being run over 4 times by a communist official, the police of Jiangsu even refused to press criminal charge, not after a through investigation, but moments after the accident before any investigation.

In many cases, the driver was seen by camera to get down to check the victim. When realizing the victim was not dead, get on the car and then run over the victim for as many times as necessary of a guaranteed kill. Some then drove away, some then calmly stayed for police.

The problem lies deeper than the lack of ethics of communist regime. Many Chinese drivers feel empathy with those who run over repeatedly. Even many media share the same sentiment, but blame the insurance and road traffic law for the drivers confusion. The theory was a driver would risk paying more on a wounded victim then a dead victim. The key issue here is, many people and the media consciously give up a basic moral value, but measure everything with money. 'Cost', instead of 'value' becomes the sole component of social architecture. Killing becomes acceptable when it saves cost.

This is an extension of the communist believe occupied China in the past, when the loyalty to the Party is the No. 1 virtue over everything else including value of life. Only that loyalty to money replaces loyalty to the Party. Not surprisingly, the new communist Party is controlled not by a shared belief of communism, but by a sharing of social resource.

Kill the Baby

The fifty-eight underlined words read: "delivered a full-term healthy boy. Without birth-permit, the County Family Planning Office official Mr Chen Bingshou instructed the baby must die. Therefore we left clogs in the baby's mouth. The baby died in 2 minutes."

The document is the medical record at the People's Hospital of Ninghai County of Zhejiang Province. It was dated April 5th, 1999.

The baby was taken out of his mother Chen Yaqin by cesarean section. He weighted 8.65 lbs. He was killed before he got a name. He was Chen's first child. Chen was 28 years old at the time.

The communist official issued the order is Chen Bingshou, the three doctors executed the death order are Jiang Weichun, Wang Guangfu, Jiang Guifen.

They all should have gone to hell. Seriously, how can killing be stopped? If the above four were sent to hell, then it would have been stopped. And other officials and doctors would have learned a lesson, to not kill.

Army Reserve Deployed by Wealthy Developer to Evict Villagers


Uniformed reserve soldiers were deployed by wealthy developer in Zhejiang Province to evict villagers from their homes so that a market could be built upon the land. Police and Para-military participation and accusations of brutality in civil commercial disputes are not new in the totalitarian communist county, but using military forces has been rather rare, until recently.

Historically Chinese rulers have been wary on loyalty of military forces. In Ming Dynasty, a wealthy patriot was executed for donating money to a troop, because only the emperor is entitled to giving to the military. During the relief effort of the Sichuan Earthquake in 2007, Chinese premier Wen Jiabao lashed out before reporters for his frustration dealing with troops. Although he is the head of the government and namingly No. 3 in the Party rank, the troop only answers to Mr. Hu Jintao, the Party Core and Chairman of the CCP Central Military Committee (CMC).

April 10, 2009, hundreds of reserved forces of the People's Liberation Army (PLA) were deployed to evict villagers to make room for a market to be developed by a real estate developer Mr. Shen Jinmu. A short video clip of the scene showed villager was beaten by uniformed soldiers. At least one senior citizen was seriously injured with multiple broken bones. Billionaire Shen hired the troop through the local government of Tongxiang, Zhejiang.

There are no Black Lung Patients in China

There were no homosexuals in Iran, as said the visiting Irian President Mahmound Ahmadinejad on a Columbia University forum in 2007.

There are no black lung patients in China despite the all well known work environment issues, as decided by the Chinese Comnunist Party.

A deadly struggle between seven black lung workers and the Party ended up deadly, as described in a recent story carried by the Nanfang Daily.

In the village of Dawu in Wanzhou of Chongqing, seven villagers set out to work in a factory in Wenzhou, Zhejiang in 1997. They were fired by the factory in 2002 when they were too ill to work. Seven came back with black lungs. They battled the legal system in the past five years. The result: five are already dead, and two are still not recognized as black lung patients. The Party boss of Chongqing, Mr. Bo Xilai, proudly stated that there were no black lung patients in Chongqing.

National Secret: Undocumented Babies Killed by Hospitals

Movie star Zhang Ziyi recently pled to entertainment reporters not to dig on her private life, because 'for your it's gossip, but for me it's my life'.

For everyone else what was revealed from a ten years old medical record is a taboo of national secret; but for Ms. Chen, it was her life forever without her own offspring. Her first baby boy, whom she was told born dead, was actually delivered alive but later killed by the hospital because she did not have proper document, the birth license. She had since unable to carry another baby.

In mainland China, one family is allowed to have one child. In addition, the couple must obtain a birth license before a child is born. It is an often troublesome procedure for many because each 'unit (the bottom level organization in charge of people's work, life, welfare etc.)' is only allocated a certain number of such licenses each year. If birth licenses run out before the end of year comes, then the options for married couples are either an abortion or carefully avoiding pregnancy. Sometimes it makes a laughable moment when co-workers have to coordinate their sex schedule so that they could fairly and wisely make use of the available birth licenses. Sometimes it became a sadden moment when some couples were told they would have to have an abortion, even when it's their first pregnancy.

Ms. Chen's pregnancy was not planned. She and her husband rushed the wedding when they found out Ms. Chen was pregnant. Before going to the hospital, they had envisioned the father could be arrested and they might have to pay a big fine. They were discussing selling the house to pay the fine. However, they didn't know and little was known to most people that the Health Ministry had a policy which dictated babies without the aforementioned 'birth license' would be secretly executed by the hospital. In China, fathers are not allowed in the delivery room, and mothers would be usually worn out to be alert of what's exactly happening. The baby would be quietly and decisively killed by the delivering doctors, and the mother would be told the child was born dead.

Ms. Chen has been a frequent visitor of fertility clinics in the past 10 years with no luck. About one month ago on July 31, 2009, when she was hospitalized for another fertility treatment at the No. 1 Ninghai Hospital, where the baby was killed tens years ago, a copy of the old medical record was accidentally given to her along with current records. That's when the national secret was leaked to Ms. Chen.


The time was 1999, and the hospital was the No. 1 Hospital of Ninghai (Address: 73 South Taoyuan Road, Ninghai, Zhejiang, 315600, PRC. Tel: +86 (574) 6557-8396. President: Fang Zhengming. Beds: 400) in Ningbo, a coastal city of Zhejiang Province. Three Obgyns were involved in the termination process. They are Drs. Jiang3, Wang and Jiang1. According to the medical record, Dr. Jiang3 carried out the execution 2 minutes after the baby was born alive.

VT Killing


A 22 years old female Virginia Tech student was fatally stabbed in a school student center, Graduate Life Center (GLC) where the girl resides. The victim is Yang Xin, a graduate student in Accounting from Beijing. Yang Xin was known as a diligent student who graduated from Memorial University of New Foundland in Canada. Yang earned a BBA (Bachelor of Business Administration) in merely two years. After graduation Yang interned at a Subway store as assistant manager while preparing for GMAT, the entrance exam for graduate study in Business School. Yang arrived the States only days ago on Jan 8, 2009 to start her study at VT.


The killer is Zhu Haiyang, a graduate assistant in the Agriculture and Applied Economics Department. Zhu comes from Ningbo in Zhejiang Province. The killer was educated in Shanghai. According to posts on Internet forums, the killer got know the victim when he picked up the girl at the airport, arranged by the VT Chinese student association as a volunteer service for new students. The duo were seen together at the Au Bon Pain restaurant on the first floor of GLC around 7 pm Wednesday evening. There had been no sign of argument. Then the girl called 911; then the killer stabbed the girl. When police arrived, they found the murderer with the knife, and the girl, ..., decapitated. Officer Nicole Irvine who responded to the 911 call 'observed the suspect holding the head of the victim in his hand (Police Search Warrant Affidavit).' The killer has a personal web space at QQ titled 'Ocean's Ocean'.

The killer's apartment management staff described him as "rude and belligerent". Will Segar, the landlord said Zhu only came to his attention because of his bellicose interaction with those around him. Segar even talked to a Blacksburg police after he observed Zhu harassing other people. However, the officer told Segar there was nothing he could do, and suggested Segar talked to the international affairs at VT. Segar went ahead, but did not receive any 'useful advice on how to deal with Zhu.'

The killer's academic background was questioned too. Zhu graduated from a little known college after the Chinese government expand the college enrollment by ten times (from 600,000 per year in late 80s to 6 million per year in the 90a). His fellow Chinese friends praised him for English skills, but both his academic adviser Denise Mainville and the department head Kevin Boyle murmured on his academic performance when inquired by reporters. The vetting process of VT is obviously flawed to have admitted any students from these kind of nobody-heard-of schools. Nonetheless, a VT nod gave the killer a virtual mandate to act at will and a false sense of entitlement. It's possible. as speculated on the Net, the killer was angered so easily by hearing a single word 'no'. It's possible though, the killer had already been scolded by the Tech and had been facing a disgraceful dismissal, which might prompt him to execute one last stunt.

Although there's no easy way to prevent a sick murder from acting crazy thoughts into action, some alleged that the role the Association of Chinese Students and Scholars (ACSS) at Virginia Tech played was facilitated by the killer. People on online forums accused them to have arranged the killer to pick up the girl from the airport. The girl was also arranged to live in the killer's apartment for four days before she was assigned a school housing unit at GLC, where she was killed. After the incident, the ACSS promptly sent out a message barring anyone from disclosing any information. The ACSS also deleted all relevant discussions at a maillist and an online forum exclusive to Chinese students and scholars at VT. The killer has been known as an enthusiastic member of the ACSS, an official organization sponsored by the communism government. Some see the ACSS, an organization supposed to benefit all Chinese students, was utilized by a small group of greedy former communists (or communists wannabes) with personal interest. Simply put, any such communism outpost should have been banned from ground of college campus.

The victim's mother in Beijing was notified by telephone last night.

Domestic Disturbance


At least one protester was beaten to death by the police, dozens seriously wounded and hundreds were arrested in Ruian, Zhejiang.


It starts as a seemingly yet another tragic domestic disturbance case, in which a depressed wife, jumped out of the window for no reason at all. Ms. Dai Haijing, a 29 years old high school teacher, who is loved by her friends and her students fell down two floors and died. It was the more than obvious non-falling caused wound on her head that told a different story, and angered everyone who know her, and thousands who have a heart.


According to police, Ms. Dai Haijing had been suffered a kind of depression that nobody else could tell from her behavior. She jumped from her home on the third floor, and there's no other obstacles in the scene. She fell upside down with her head hit the ground. The would on her head was caused by the impact on the ground. Give me a break, we taxpayers spent so much each year on the police, they could have used a better story.

Ms. Dai's husband Mr. Xie Deyong is one of the most wealthiest and most connected person in the area. According to Internet 'rumors', the family has a long trace of violence. Close friends of Ms. Dai told press that Ms. Dai had been beaten by her husband many times before. The government swiftly announce the death was a result of suicide without bothering checking the crime scene. Although it's still in the summer recession, thousands students in the school she taught paraded in protesting the handling of the case by the local government. Photos of the scene were spread to every online forums in the Chinese language Internet community.

Yesterday, the Ruian government mobilized police forces, SWAT team and even military police to shut off thousands of protesters on the unfair judgement. All online discussions were deleted.


September 10th is the official 'National Teachers' Day' in China. Tens of thousands of people in Ruian showed their ultimate respect to Ms. Dai Haijing with their blood, and some with their lives. Most of these dead and wounded had never of Ms. Dai before, but they felt a need as a Chinese citizen to contribute their blood when it was called for. Great ancient philosopher Laoze (570 - 470 B.C.) had said, 'How can you scare people with death when they are no longer afraid of death?' The government officials of Ruian, Zhejiang should have read that in high school textbook.

High school students Protest in China

Why do students demonstrate in China? First of all, please remember that high school student demonstrations do not happen that frequently and so there must be something extraordinary.

Here is the translation of the students' open letter to the public :

On August 18, when we heard the bad news that our teacher has committed suicide, we could not believe that such a bright person would be so stupid as to kill herself. As a university graduate in English, how could she be so psychologically feeble? On the day before she died, she told us that she will be giving us dictation the next day. She is a reliable person, so why would she lie to us? She told us that life is like a coin, and we should see the good side instead of being stuck under the dark skies all the time! ... So how could she have killed herself? She has a son who is only two or three years old, so how could she abandon him alone in the world! Does she not know that a motherless child is lonely and helpless??

The incident took place two days ago. Why has law enforcement refused to investigate? Why is the legal doctor late? Why are the people's guide -- the media -- also late? We don't understand! In a society under the rule of law, something infuriatingly unjust has happened! Our rights become so pale and powerless in the face of money!

Here is a summary of our doubts:

1. Before the day of the incident, our teacher asked us to memorize the nouns because she was going to give us dictation the next day. She patted the head of one student and smilingly "warned" him that he better memorize the nouns. How could a suicidal person tell such a joke so light-heartedly?

2. If she wanted to kill herself, would she be wearing only her underwear??! Our teacher is a pretty woman who wants to look well. Would she want to die in such indignity?

3. The teacher's child is so young and she loves him so much. Would she abandon him?! Besides, a suicidal person should have made some arrangements beforehand. But our teacher did nothing ...

4. Afterwards, we read the teacher's diary. She wrote that she will not rely on others. She will only rely on herself and she write that she will be strong. She wrote that she is a mother and she is the world to her son. Motherly love is so great! Would she give up life so easily and abandon her young child?

5. When we saw the body of our teacher, she had bruises everywhere. Although her limbs were intact, her cranium was burst open. She died a horrible death.

6. Our teacher told us that the High School Third Year Class teachers work very hard. She said that she will not be satisfied if we get into the universities. So why would she choose suicide?

7. The law enforcement department refuses to intervene in this matter. Justice is so pale and powerless in front of money. How will the people ever trust the government again?

Therefore, we ask all righteous people to extend your righteous hands to give justice to our teacher! This is on behalf of all the teachers under the heavens! May our teacher rest in peace!
